CONDITIONS GENERALES

Art. 1 – NORMES ET INFORMATIONS 

Le présent règlement énonce les conditions générales d’inscription aux cours ainsi que les droits et obligations des participants aux cours MTC-Training&Consulting et sous le nom de MTCTraining. Après l’inscription, le candidat accepté reçoit une confirmation contenant les détails de son cours. Les cours Blockchain sont soumis au conditions régis (en anglais) disponible sur le site  MTC_BTA Blockchain Training policies.

Art 2 – ADMISSION

Seuls sont admis dans le cours les participants figurant dans la liste de classe et ayant réglé les frais d’inscription et d’écolage.

Art 3 – PAIEMENT

Les frais de dossier, pour les cours le mentionnant, s’élèvent à CHF 60.- (CHF 150.- avec Visa/Permis d’étudiant). Cette somme n’est pas remboursable. Les cours sont à payer intégralement avant le début du cours. La direction peut accorder le paiement par acomptes.

L’écolage inclut les leçons. Sont exclus : les supports de cours (sauf avis contraire), les taxes d’examens, les assurances.

Les frais bancaires/postaux et d’assurance sont à la charge de l’étudiant

Art. 4 – LIVRAISON

Les cours sont livres en ligne, avec ou sans formateur et en présentiel dans les locaux MTC ou chez le client.

Art 5 – ANNULATION DU COURS PAR LE PARTICIPANT 

Toute annulation de cours doit être annoncée par écrit. Pour annulation notifiée : 25 jours avant le début du cours, 100 % du montant de l’écolage payé sera remboursé. Entre 24ème et 11ème jour déduction de 1% par jour. Dès le 10ème jour avant le début du cours, le 100% de l’écolage payé sera mis au crédit du compte du participant pendant 6 mois. Passé ce délai, aucune ristourne ne sera effectuée. Les conditions particulières sont applicables en cas de force majeur.

Aucun remboursement n’est dû dès le début du cours, pour la non-participation au cours, pour abandons, absences ou interruption du cours, pour les leçons coïncidant avec Pâques, l’Ascension, le lundi de Pentecôte, le 1er Août, et le Jeûne genevois. Une leçon privée est annulable 24 h avant l’horaire prévu ou selon les conditions convenues. 

Art 6 – ATTESTATION, CERTIFICAT, DIPLÔME 

Une attestation de présences au cours est délivrée pour une participation minimale de 80%. Les participants ayant passé le test final avec succès reçoivent un Certificat. Aucune attestation ne sera délivré en cas de:

• Non-paiement de la totalité du prix du cours.
• Si la participation du cours est inférieure à 80% (sauf absence en cas de force majeure). 

Art 7 – ANNULATION DE LA PART DE MTC

La direction peut en tout temps fermer ou annuler un cours pour des raisons internes. L’étudiant aura droit au remboursement intégral ou pro rata des leçons n’ayant pas eu lieu. Aucun remboursement n’est dû pour un cours suspendu temporairement ou déplacé dans le temp.

Art 8 – MATÉRIEL, RESSOURCES, LOGICIELS ET DONNÉES, cours en présentiel

Les usagers doivent conserver en bon état le matériel et la documentation mis à leur disposition. Les ressources informatiques sont utilisables uniquement dans le cadre des actions d’apprentissage en relation avec le cours. Toute copie est interdite. Dans le cas d’une dégradation matérielle, le responsable serait tenu de réparer les dégâts. La souscription à une assurance de responsabilité civile est recommandée. 

Art 9 – DOMMAGES, PERTE D’OBJETS, cours en présentiel

MTC décline toute responsabilité pour les éventuels dommages aux biens ou vols pouvant survenir dans ses locaux.

Art 10 – MODIFICATIONS DES PROGRAMMES ET DES PRIX

La direction se réserve le droit de procéder à des modifications des programmes, des prix, ainsi que des Conditions Générales en tout temps.

Art 11 – CONDITIONS COURS BLOCKCHAIN

Les conditions Cours Blockchain sont régis par MTC_BTA Blockchain Training policies.

Art 12 – LIEU DE JURIDICTION

Tout litige, controverse ou réclamation découlant de ou en relation avec la présente relation contractuelle, y compris la validité, la nullité, la violation ou la résiliation de celle-ci, est soumis exclusivement au droit suisse. Il sera résolu par arbitrage conformément au Règlement suisse d’arbitrage international 2012 (Swiss Rules 2012) de Swiss Chamber’s Arbitration Institution en vigueur à la date à laquelle la notification d’arbitrage est soumise conformément à ce règlement.

Le siège de l’arbitrage est à Genève.

GENERAL TERMS AND CONDITIONS

Art. 1 – STANDARDS AND INFORMATION

These regulations set out the terms and conditions for course registration as well as the rights and obligations of participants in MTC-Training & Consulting courses under the brand name GSM, PMP-Training. After registration, the accepted candidate receives a confirmation containing the details of the course. Terms and conditions for Blockchain  courses are governed by MTC_BTA Blockchain Training policies available on the MTC-BTA Blockchain Training policies.

Art 2 – ADMISSION

Only participants from the class list who have paid the registration and tuition fees are admitted to the course.

Art 3 – PAYMENT

An application fee, may be charged for classroom coursers mentioning it, CHF 60.- (CHF 150.- with Visa / Student Permit). This amount is not refundable. Lessons must be paid in full before the start of the course. Management can grant payment by installments.

Schooling includes lessons. Excluded are: course materials (unless otherwise stated), examination fees, insurance charges

Art. 4 – DELIVERY

Courses are delivered online, with or without an instructor, and in person at MTC’s premises or at the client’s site.

Art 5 – CANCELLATION OF THE COURSE BY THE PARTICIPANT

Any course cancellation must be announced in writing. For notified cancellation: 25 days before the start of the course, 100% of the paid tuition amount will be refunded. Between 24th and 11th day a deduction of 1% per day will apply. From the 10th day before the start of the course, 100% of the paid tuition will be credited to the participant’s account for 6 months. After this period, no refund will be granted. The special conditions apply in the event of force majeure.

No reimbursement is due once the course has started, for non-participation in the course, for dropouts, absences or interruption of the course, for lessons coinciding with Easter, Ascension, Whit Monday, August 1, and the Geneva Jeûne Genevois. A private lesson can be canceled 24 hours before the scheduled time or according to the agreed conditions.

Art 6 – CERTIFICATE, DIPLOMA

A certificate of attendance at the course is issued for a minimum participation of 80%. Participants who have successfully passed the final test receive a Certificate. No certificate will be issued in the event of

• Non-payment of the full course price.
• If the course participation is less than 80% (except absence in case of force majeure)

Art 7 – CANCELLATION BY MTC

Management may at any time close or cancel a course for internal reasons. The student will be entitled to full reimbursement or pro rata for lessons that have not taken place. No refund is due for a course suspended or moved in time.

Art 8 – MATERIAL, RESOURCES, SOFTWARE AND DATA, Classroom training

Users must keep the equipment and documentation at their disposal in good condition. The IT resources can only be used in the context of learning actions related to the course. Any copying is prohibited. In the event of material damage, the person responsible will be required to repair the damage. The purchase of civil liability insurance is recommended.

Art 9 – DAMAGE, LOSS OF OBJECTS, Classroom training

MTC declines all responsibility for any damage to property or theft that may occur on its premises.

Art 10 – CHANGES TO PROGRAMS AND PRICES

The management reserves the right to make changes to the programs, prices and Terms &l Conditions without further notice.

Art 11 – TERMS AND CONDITIONS FOR THE BLOCKCHAIN COURSE

Conditions for Blockchain courses are governed by MTC-BTA Blockchain Training policies

Art 12 – JURISDICTION and VENUE. 

Any dispute, controversy or claim arising out of or in connection with this contractual relationship, including the validity, nullity, breach or termination thereof, shall be subject exclusively to Swiss law. It shall be resolved by arbitration in accordance with the Swiss Rules of International Arbitration 2012 (Swiss Rules 2012) of the Swiss Chamber’s Arbitration Institution in force on the date on which the Notice of Arbitration is submitted in accordance with these Rules.

The seat of the arbitration shall be in Geneva.
